Plaintiff Carmen Mims was a 45 year old woman working as a Leasing Professional at the Savanah Sound Apts, starting 6/30/08 then transferring to full time work in Leasing at Banyan Bay Apts 5/29/09.
On Jan 29, 2010 Plaintiff filed a Charge of Age Discrimination against Concord.
At 45, Plaintiff was the oldest of 3 women working in the Leasing Dept, the other women were 22 and 30 years of age. On 12/14/09 the 2 younger women were making fun of older women who had gone back to college for a degree, as they ‘had one foot in the grave’ and Plaintiff questioned why they were doing this and received an abrupt reply from the other women. Plaintiff discontinued the conversation and went to lunch.
On 12/17/09 Plaintiff was called into the office and fired, the prior conversation was cited as the reason, she was given 30 days to vacate the apartment she was renting. Concord then hired a woman in her 20’s to replace Plaintiff.
Mims and Concord reached a ‘Confidential Settlement Agreement’ on 9/24/10 and the case was Dismissed.
